pinching tunes or bad luck?

In 1994 a friend and I wrote a stage show which is not published yet. Years later I realised that one of my tunes was in fact similar to an already published one. It is eleven notes before the two tunes become different but mine has a shorter pause between the third and fourth notes. This similarity was never intended and is merely the same combination. I've heard that a drum track can be identical to another for four seconds before you are in trouble. Am I safe or not?
