If you bought a cd for a friend or family member for Christmas you would'nt have them pay royalties to the artists so why would file swapping be any different?
You have missed the fundamental difference
between giving someone a CD as a gift that you
have purchased, and giving someone music via file
sharing.
In the first case you have purchased the 'gift'
and paid the royalties, and you no longer have the
CD that you gave away. The owner of the music got
paid and no copies of the music were made.
In the second case - you have given the music away
(most likely without paying for it - but that's
partly a different argument) and you still
have it afterwards.
So you haven't given a gift, you have made a
copy - and the owner (who is not you) has not
been paid.
I'm all for debate on copyright and intellectual
property rights in general - so long as the
arguments are not so obviously flawed as are the
comments above.
